UCC Membership - Lawsuit Settlement

This information is of a legal nature but IBCA is not offering legal advice or acting in any capacity other than being a clearinghouse of information.

A number of associations and individual companies have contacted IBCA to find out about invoices sent out by the Uniform Code Council (UCC). Many companies paid the UCC for membership and an identification number years ago and didn’t understand why they were being asked to pay again.

The situation resulted in a lawsuit and the terms of the settlement can be found at by contacting the UCC (now GS1) at 609-620-0200.

Quoting the UCC Settlement web site:

This Settlement provides that companies who became members of UCC before August 28, 2002, are not obligated to pay membership renewal fees to UCC to maintain membership as a condition for their use of Company Prefixes issued to them by UCC, or as a condition for Basic Membership Benefits as defined in the Class Settlement Agreement. Class members who have paid a renewal fee to UCC are entitled to compensation from a $3,895,000 settlement fund. The settlement also provides that the "licensing agreement," which accompanied UCC renewal fee invoices, is null and void as to those who became members in UCC before August 28, 2002.

IBCA was established in 1985 by 10 NAW member associations to help companies implement and maintain supply chain systems using bar codes and electronic communications. Today IBCA acts as a clearinghouse of information and provides education and awareness programs to help companies use supply chain technology. For more information go to www.ibcaweb.org .
